The IP address is used in particular to determine the user's country of residence and to preset the language of the website accordingly. This consent constitutes the legal basis for the processing of your data within the meaning of Art. 6 para. 1 lit. a GDPR. SkAI Data Services is entitled to commission third parties with the technical processing of advertising measures and is entitled to pass on your data for this purpose.

You can withdraw your consent to the processing of your data at any time (at
contact@skai-data-services.com). After revocation, your personal data will be deleted.

 

4)     Use of your data for advertising purposes

a)     In general

SkAI Data Services may use personal data of users of www.skai-data-services.com to advertise its services (online and/or print advertising, etc.). SkAI Data Services is permitted to pass on personal data to third parties acting on behalf of SkAI Data Services for this purpose. By using the website, the user expressly agrees to this use of his/her data.

a)     Google Analytics

SkAI Data Services uses the online advertising program "Google Ads" and conversion tracking as part of Google Ads. Google Conversion Tracking is an analysis service provided by Google Inc (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; "Google"). When you click on an advertisement placed by Google, a cookie for conversion tracking is stored on your computer. These cookies lose their validity after 30 days, do not contain any personal data and are therefore not used for personal identification. If you visit certain Internet pages of the website and the cookie has not yet expired, Google and SkAI Data Services can recognize that you have clicked on the ad and have been redirected to this page. Each Google Ads customer receives a different cookie. It is therefore not possible for cookies to be tracked via the websites of Ads customers.

The information obtained using the conversion cookie is used to generate conversion statistics for Ads customers who have opted for conversion tracking. This tells them the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users.

11)  Transfer of personal data abroad

SkAI Data Services is also entitled to transfer your personal data to third-party companies (contracted service providers) abroad, provided that this is necessary for the data processing described in this privacy policy and if this does not seriously jeopardize the privacy of the data subjects.

These third-party companies are obliged to protect data to the same extent as SkAI Data Services. If the level of data protection in a country does not correspond to that in Switzerland or the EU, SkAI Data Services will contractually ensure that the protection of your personal data corresponds to that in Switzerland or the EU at all times. Where necessary, the user expressly agrees to this.

Users residing in an EU member state or Switzerland are advised that the USA does not have an adequate level of data protection from the perspective of the European Union. The new Data Privacy Framework (data protection agreement between the EU and the USA) came into force on July 10, 2023. US companies can join the framework by committing to comply with data protection regulations. This will make data transfers to the USA much easier. US companies can attest to their participation in the data protection framework through certification. The agreement is administered by the US Department of Commerce. This is also where the certification applications are processed and monitored.

Where possible, SkAI Data Services transfers data to the USA to appropriately certified companies. If this is not the case, there is a risk that user data will be processed by authorities for control and monitoring purposes, possibly without the possibility of legal recourse.

 

12)  Right of access, rectification, erasure and restriction of processing; right to data portability

You have the right to receive information about the personal data stored about you by SkAI Data Services free of charge upon request. In addition, you have the right to rectification of inaccurate data and the right to erasure of your personal data, provided that this does not conflict with any legal obligation to retain data or a permission that allows SkAI Data Services to process the data. You also have the right to request the restriction of data processing and to object to data processing.

You also have the right to request the return of the data that you have provided to SkAI Data Services. Upon request, SkAI Data Services will also forward the data to a third party of your choice. You have the right to receive the data in a commonly used file format.
